Black days begin for "non gratats" in the Balkans, Dodik risks being arrested after November 22, may be sentenced to up to 5 years in prison, the Bosnian Serb leader, fearing handcuffs, seeks protection from a well-known Croatian lawyer
Written by Elmas Bogdani 14 Nëntor 2023
Bosnian-Herzegovinian lawyers for Bosnian Serb leader Milorad Dodik are trying to convince Croatian lawyer Anta Nobilo to join the team that will defend Dodik in his upcoming trial before the Court of Bosnia and Herzegovina, which could cost him his political career, but he could also end up in prison. Nobilo personally confirmed the news. "I've had contact, that's correct, but I wouldn't say anything more about it until we define everything to the end. But, I've had contact and we'll see what happens," said Nobilo. He expects that in in the following days, everything will be clarified, but he emphasized that he cannot be a lawyer in Bosnia and Herzegovina, but only an advisor to the defense team. Dodik's trial in Sarajevo begins on November 22, and the indictment of the BiH Prosecutor's Office accuses him of non-implementation of decisions of the high representative of the international community. This was made a criminal offense based on changes to the Criminal Code of BiH that were imposed by current High Representative Christian Schmidt in early July. He also repealed two laws by which the parliament of Republika Srpska tried to block the implementation of the decisions of the Constitutional Court of BiH as well as the decisions of the High Representative himself, but Dodik then signed a decree for the entry into force of the decision to annul the laws.
Together with him, Milosh Luki?, the director of the Official Gazette of RS, who published the controversial laws in that press, was also accused. Because of this, Dodik and Lukic now face a sentence ranging from six months to five years in prison, and a guilty verdict means being barred from holding all public office. Dodik's main defense attorney is lawyer Goran Bubiq, who also represented him at the plea hearing, where the current RS president stated that he did not understand the indictment, so the judge concluded that he was not guilty. Dodik and Luki?'s defense is based on the claim that Schmidt is not a legally elected high representative because that appointment was not confirmed by the Security Council of Bosnia and Herzegovina and therefore does not have the authority to enact laws and amend them. including those that make non-implementation of its decisions a criminal offence. Only Russia supports Dodik and the RS authorities in opposing Schmidt's mandate, while all other member countries of the Peace Implementation Council (PIC), the body that appoints the high representatives, are of the opinion that the German politician has all the powers of necessary to hold the office of high representative can dismiss elected officials and enact laws.
USA calls for investigation into Dodik
On the other hand, international calls have recently been made for Dodik to be banned. The US ambassador to Bosnia and Herzegovina, Michael Murphy, has called for local authorities to launch investigations as he is on the US blacklist for corruption. Also, Gunhter Fehlinger, an Austrian economist and lobbyist for the EU and NATO, who regularly comments on events in Europe and the world, has sounded the alarm for NATO, referring to the recent situation after the President of the RS Milorad Dodik again called for the dissolution of Bosnia-Herzegovina and announced the unification of Serbia, Montenegro and Kosovo. "In case of war, we must bomb Banja Luka and demolish the new building of the Government of Milorad Dodik within two hours after he starts his war for secession. This is the only way to talk to Dodik and prevent him from starting his Balkan war", writes Fellinger in a post on social networks. Earlier, Fellinger called on NATO to seriously warn Milorad Dodik. "If Milorad Dodik starts a war for the secession of Bosnia, which Putin wants already this winter, I will call in the US Navy to bomb your government building within minutes. This is the target location. And I'm asking the US Navy to act quickly," said Fellinger.
