They "fed" their companies with tenders, Klodiana Lala reveals the sensational details: This is how the directors of Tirana Municipality "sunk"

Klodiana Lalla addressed this Wednesday, the most recent arrests in Tirana Municipality, where Mariglen Qato and Redi Molla, with leadership positions in this municipality, fell into the hands of SPAK.

The latter, in the period when they received these positions, founded the company that today bears the name '5D Konstruktion', where they were the hidden owners, commercial companies that fed themselves with tenders.

They became the next directors in the Municipality of Tirana to fall into the clutches of SPAK, confirming that corruption has become a real structure, extending from the central to the local government. And the scheme seems to be similar, as in other cases, the future directors climb to such positions and heights, not simply for their management ability, but also to camouflage themselves as partners in various businesses, who then, as soon as they get public positions, the income of these businesses increases many times and they are sold to their family members for ridiculous amounts.

An apparently numbers game, but with its breakdown, it is revealing one of the ways that local leaders or above, have chosen to hide businesses. But not only that, they also feed them with tenders, while the government has already taken them for its own purposes, placed at the head of these institutions. This example seems to be that of Mariglen Qato and Redi Molla, both managers at different times of affairs in the Municipality of Tirana, who were placed in handcuffs by SPAK.

Qato had held the position of head of the IMT (Territory Protection Inspectorate) in the Municipality of Tirana, and Redi Molla that of 'Ujjejella Kanalizime', but together they were linked by a construction company called '5D Construction', a company which they had established during the time they had taken the leadership positions in the Municipality of Tirana, hiding the fact that they were the real owners and the conflict of interest, selling it from time to time to people close to them, as well as changing frequently name.

Qato, before he was assigned to work in the municipality, was first appointed as the Director of the Directorate of Public Works No. 2 in 2015, then as Director of the Tirana Waterworks, and until the local elections of May 14, 2023 he was in charge of the IMT. He owned a business based on dough products, and was recently in charge of 'Tirana DC' sh.a. It is interesting how he created in 2016, together with his friend Redi Molla, the company '5D Construction', which was registered at the National Business Center on January 21, 2016, initially under the name 'Igor Elektrik'. The sole shareholder turned out to be Eduart Meta, but it turns out to be an acquaintance of Mariglen Qatos.

From the examination of the documents seized in the premises of the company '5D Konstruksion' sh.pk as well as the analysis of the data through computer expertise, other evidence was found which proves that the citizens Eduard Meta, Muhamet Petriti and Nestor Muhametllari were not the partners of of the commercial company, now with the name '5D Konstruksion' sh.pk, but their ownership of the company's shares was registered fictitiously.

It turns out that the actual owners are the citizens Redi Molla and Mariglen Qato, who are suspected to have owned this commercial company indirectly, through the above persons, since 2016 when it was founded.

According to the investigative file provided by the show 'Në Shënjester', the company was founded during the time that Qato and Molla were in management positions in the Municipality of Tirana, however, its administrator on paper was the citizen Eduart Meta, while in the first year there was a profit annual of 760 thousand dollars. It was sold for only 75 new lek to the citizen Muhamet Petriti, who turns out to be the father-in-law of Alfred Qato, Mariglen Qato's brother.

In 2018, Muhamet Petriti becomes a 100 percent shareholder of the company '5D Konstruksion' and appoints the citizen Nestor Muhametllari as administrator of the company. However, only three years later, in 2021, he sells the company to Muhametllari for only 10 thousand euros, despite the fact that the trading company had a turnover of 9 million euros and a profit of 2 million euros. Meanwhile, from its establishment in 2016 to 2022, according to the balance sheet filed at the National Business Center, the company had revenues in the amount of 22 million euros.

The main accusation that SPAK has raised against the two former directors of the Municipality, Mariglen Qato and Redi Molla, is that they are actually the owners of the company '5D Konstruksion' and have used their leadership position in the Municipality to favor their company in tenders , serving with tenders contrary to the law and creating an open conflict of interest, favoring it compared to other companies

SPAK has confirmed their connection with the company '5D Konstruksion' through their conversations with their subordinates, including the fact that the company won the first tender from the Municipality of Tirana just a month after it was founded in 2016, under the name 'Igor Elektrik' . Her first employers were Redi Molla, as director of the Tirana 'Water and Sewerage', and Mariglen Qato at the head of the procurement commission.

The company '5D Konstruksion' was registered in January 2016 by citizen Eduart Meta, electrician by profession under the name 'Igor Elektrik'. This company won the first tender, less than a month after its establishment.

The Contracting Authority was 'Ujjesjellas Kanalizime Tirana' s.a., which at that time was headed by Redi Molla, while the chairman of the procurement commission was Mariglen Qato.

Edhe pse Eduart Meta ia shiti 75 përqind të aksioneve Muhamet Petritit, vjehrrit të vëllait të Mariglen Qatos, në janar të vitit 2017, ai mbeti administrator i kompanisë deri më qershor të vitit 2018, kur administrimin e mori Nestor Muhametllari. Gjatë kësaj kohe, në dhjetor të vitit 2018, Eduart Meta i shiti edhe 25 përqind të aksioneve të mbetura në pronësi të tij, shtetasit Muhamet Petriti, momenti kur kompania ndryshoi emrin nga ‘Igor Elektrik’ në ‘VAS Konstruksion’ sh.p.k.

Në vitin 2021, pasi Muhamet Petriti ia shiti kompaninë Nestor Muhametllarit, shoqëria ndryshoi sërish emrin dhe në vazhdim do të quhej ‘5D Konstruksion’ sh.p.k. Megjithatë, siç del edhe në dosjen e Prokurorisë, Muhamet Petriti është përdorur thjesht si një ‘prestanome’, pasi në të vërtetë të gjitha komunikimet në vazhdim i ka me vëllain e Mariglen Qatos, që është edhe dhëndri i Muhamet Petritit.

Muhamet Petriti, rezulton se është një bukëpjekës. Ai e merr pagesën dhe paguan sigurimet shoqërore në biznesin që drejton bashkëshortja e tij. Ai del se nuk ka kontakte me administratorin e kompanisë Nestor Muhametllari.  Ky i fundit kur do ta telefonojë Muhamet Petritin, numrin e tij ia kërkon Alfred Qatos, vëllait të Mariglen Qatos.

Që Muhamet Petriti nuk është pronari i vërtetë i kompanisë ‘5D Konstruksion’, pavarësisht se emri i tij figuron si pronari i saj para se aksionet t’i shiste Nestor Muhametllarit, kjo vihet re edhe te një nga bisedat që ky i fundit bën me Alfred Qaton, vëllain e Mariglen Qatos, ku e këshillon që t’i thotë Muhametit të shkojë në bankë dhe të tërheqë paratë.

Në një moment Nestor Muhametllari i thotë Alfred Qatos që vjehrri i tij Muhamet Petriti i cili në letra është pronari i kompanisë të shkojë dhe të bëjë tërheqjen e parave në bankë.

Çka tregon se Muhamet Petriti është thjesht një emër fiktiv në kompani, përsa kohë që ai thuajse nuk ka kontakte me administratorin Nestor Muhametllari. Ndërsa ky i fundit ka qindra telefonata me vëllezërit Alfred dhe Mariglen Qato.

Një tjetër provë që konfirmoi se pas emrave të Muhamet Petritit dhe Nestor Muhametllarit, ishin ato të Mariglen Qatos dhe Redi Mollës, është edhe fakti që dy drejtorët e bashkisë, morën dividentë nga pronari në letra i kompanisë, para të cilat më pas u investuan në pallate, midis të cilëve edhe një objekt luksoz në Durrës.

Redi Molla dhe Mariglen Qato morën dividentë nga pronari i kompanisë Muhamet Petriti, ndërsa vetë ky i fundit paguhej në mënyrë informale nga kompania që sipas dokumenteve zyrtare e kishte në pronësi. Dyshimet janë se paratë janë investuar në ndërtime pallatesh. Kjo pasi nga të dhënat në QKB, pas vitit 2016, kompania nisi të ndërtojë 5 objekte, mes të cilëve dhe një hotel luksoz në Durrës.

Qato dhe Molla, si drejtuesit e kompanisë ‘5D Konstruksion’, ishte diçka e ditur edhe punonjësit, të cilët flisnin hapur për këtë fakt dhe nuk përpiqeshin ta mbajnë të fshehtë. Megjithatë, me interes për grupin hetues ishte një bllok shënimesh i gjetur gjatë kontrollit në banesën e shtetasit Nestor Muhametllari, ku ai kishte shënuar edhe pagesat që duhet të merrnin personat me inicialet ‘R’ dhe ‘M’, konkretisht sipas SPAK, Redi Molla dhe Mariglen Qato.

Gjatë kontrollit në banesën e shtetasit Nestor Muhametllari u gjet edhe një bllok shënimesh, me ngjyrë të zezë, i cili përmban një sërë shënimesh. Ku në këtë bllok ka edhe shënime për punët e shoqërisë, për kontrata publike të fituara nëpërmjet procedurave të prokurimit, etj.  Shënime ku bëhet fjalë edhe për shuma monetare që janë paguar apo që janë marrë, që janë kthyer, duke iu referuar personave të shkruar me inicialet (R) dhe me (M).

Por ky nuk ishte blloku i parë i shënimeve që iu gjet Nestor Muhametllarit, ku përmendeshin pagesat dhe krah tyre edhe inicialet ‘R’ dhe ‘M’. Në një tjetër bllok të gjetur në zyrën e tij, u identifikuan edhe shifra konkrete, se sa para kishin tërhequr këta dy persona, nga kompania që në letra ishte ende në pronësi të Muhamet Petritit.

Gjatë kontrollit në ambientet e zyrës së shoqërisë ‘5D Konstruksion’ sh.p.k, në zyrën e shtetasit Nestor Muhametllari, u gjet edhe një bllok ngjyrë blu. Nga aty del se personi me inicialin (R) ka marrë shumën prej 11 000 000 lekë nga fitimi i realizuar në vitin 2018, ndërsa personi me inicialin (M) ka marrë shumën prej 4 000 000 lekë, nga fitimi i realizuar në vitin 2018.

Dy blloqe të ngjashme, grupi hetues gjeti edhe në administrim të punonjësve të tjerë të kompanisë, ku bëhet fjalë për periudhën kohore gjatë muajit shkurt 2022. Shënime të tilla përfshinin diskutime për mbledhjen e ortakëve, dhe aty ku figuron edhe emri ‘Redi’, i cili sipas prokurorisë, referohet shtetasit Redi Molla.

Në zyrën e ‘5D Konstruksion’ sh.p.k u gjet edhe një bllok tjetër i cili i përket shtetasit Maringlen Lika, punonjës në këtë shoqëri, ku u gjetën shënime për mbledhjen me stafin e shoqërisë. Në bllokun e dytë përshkruhet qartë se në mbledhjen me stafin ka marrë pjesë edhe personi me emrin ‘Redi’, si dhe një shënim lidhur me pagesën e fitimit të pashpërndarë për vitin 2019, ku shoqëria ka shpërndarë dividentin, i cili pas tatimit ka qenë në shumën 31 505 177 lekë, e cila përputhet me shënimet e gjetura në bllokun e shtetasit Nestor Muhametllari.

Nestor Muhametllari, i cili nuk kishte asnjë komunikim me Muhamet Petritin, provoi se ai mbante komunikime të vazhdueshme me vëllezërit ‘Qato’ përmes zbardhjes së celularit të tij. Në një nga këto biseda, Nestori i kujton Alfred Qatos që t’i thotë Muhametit të shkojë të tërheqë në bankë shumën prej 10 mijë euro, me të cilën shiti kompaninë te ai.

The day after, Alfred Qato confirms to Nestor that he has spoken with his brother Marigleni and that everything is in order.

In the conversation of August 12, 2020, Alfred Qato asks Nestor to go to the bank the next day, as "Meri said so". The investigation showed that the person with the name 'Meri', with whom the above persons are addressed, is Mariglen Qato, as the number with the name 'Mer Qato' was found registered on Nestor Muhametllari's phone.

One of the pieces of evidence that the investigative group has in its hands are the bank transfers of money transferred from the company owned by Muhamet Petriti to Nestor Muhametllari and the Qato brothers.

From the data of the bank account of the citizen Muhamet Petriti at the Bank.... it turned out that on July 22, 2020, the amount of ALL 25,000,000 was transferred to his bank account, with the description; "2019 dividend distribution", transferred from the company "VAS Konstruksion" sh.pk

This amount was withdrawn piecemeal by citizen Muhamet Petriti from August to October 2020, according to the instructions of citizens Nestor Muhametllari, Alfred Qato, and citizen Mariglen Qato. This dividend amount is considered as a right/liability for 'Partner I'.

After finishing the tax payments with Muhamet Petriti, thus implying their repayment, Nestor Muhametllari turns out to have hundreds of phone calls with Mariglen Qaton as well as with Redi Molla. These calls were made in a period of nearly four years, since he took over the construction company '5D Konstruksion'. This high flow of calls, according to the prosecution, shows his connection with those who are considered the real owners of the company, in this case Mariglen Qato and Redi Molla.

For the time period from September 20, 2019 to June 7, 2023, it turns out that Nestor Muhametllari had 1011 phone calls with citizen Mariglen Qato. Likewise, during this period, this citizen had 528 phone calls with citizen Redi Molla.
