The Special Prosecutor's Office Against Organized Crime and Corruption (SPAK) reacted yesterday regarding the handcuffing of the former mayor of Durrës, Vangjush Dako, who is accused of the criminal offense "Abuse of office", while warning of the initiation of the investigation against the persons who tried to de-conspire the arrest of the former mayor of the coastal city. In the press release, SPAK informs that Dako, in cooperation with other former officials, "legalized an object built before the issuance of the construction permit, and not according to the approved project." Therefore, it is reported that the former mayor together with the director of the construction company, the architect and the surveyors have misused their duties, where it is cited that the latter "did not reflect in the technical-legal documentation, of the object the truth about the time when the works were done and the construction was carried out, making these acts falsified in content". "The Special Prosecutor's Office Against Corruption and Organized Crime has conducted investigations within the framework of criminal proceedings No. 197 of 2020, for the criminal offenses of "Abuse of duty" and "Forgery of seals, stamps or forms", the latter committed in the form of forgery of forms approved by the persons tasked with drafting them, carried out in cooperation provided by articles 248 and 25 and 190/3 and 25 of the Criminal Code. After carrying out numerous investigative actions, at the request of the Special Prosecutor's Office, the Special Court of First Instance for Corruption and Organized Crime with decision No. 57 dated June 6, 2023 has decided: The appointment of the security measure "Arrest in prison", provided by article 238 of the Code of Criminal Procedure, for the person under VD investigation, as a person suspected of committing the criminal offense of "Abuse of duty" committed in cooperation, provided by articles 248 and 25 of the Criminal Code 2 (two) times. De-conspiracy of the action to arrest Dako

Ndërkohë SPAK ka nisur dje hetimet ndaj personave që dyshohet se kanë nxjerrë sekretin hetimor në lidhje me arrestimin e ish-kryebashkiakut Vangjush Dako. Hetimet kanë nisur për  funksionarët e drejtësisë, personelin administrativ të organeve procedurale, si dhe çdo person tjetër që ka marrë dijeni për veprimet procedurale për shkak të funksionit të tij, të cilët mundet të kenë zbuluar të dhënat sekrete ndaj personave të tretë. “Prokuroria e Posaçme kundër Korrupsionit dhe Krimit të Organizuar, mbi bazën e verifikimeve të kryera kryesisht, ka filluar hetimet për kryerjen e veprës penale ”Zbulimi i akteve ose të dhënave sekrete”, të parashikuar nga neni 295/a i Kodit Penal. Fillimi i hetimeve kryesisht për këtë vepër penale është bërë për shkak të zbulimit ndaj të tretëve të të dhënave dhe të përmbajtjes së akteve procedurale, të cilat përbëjnë ”sekret hetimor”, që lidhen me veprimet procedurale të paraqitjes dhe të shqyrtimit të kërkesës me objekt caktimin e masave të sigurimit në ngarkim të shtetasve V.D etj, të kryera në kuadër të procedimit penal nr.197 viti 2020 të Prokurorisë së Posaçme. Objekt i hetimeve do të jenë veprimet e të gjithë personave të përfshirë në kryerjen e veprimeve procedurale për caktimin e masave të sigurimit për procedimin penal nr.197 viti 2020, duke përfshirë funksionarët e drejtësisë, personelin administrativ të organeve procedurale, si dhe çdo person tjetër që ka marrë dijeni për veprimet procedurale për shkak të funksionit të tij, të cilët mundet të kenë zbuluar të dhënat sekrete ndaj personave të tretë”, njoftoi dje SPAK.
