After submitting the file to the Special Appeal, the trial panel is determined to decide on the former Minister Saimir Tahiri

After submitting the file to the Special Appeal, the trial panel is determined

Yesterday, the trial panel was appointed to review the file against former Interior Minister Saimir Tahiri and former senior official Jaeld Çela. The file was registered in the Special Court of Appeals a few days ago. In the first draw, Tahiri's case would be chaired by Judge Miliana Muça and members Judges Daniela Shirka and Ilirjana Olldashi. Judge Miliana Muça resigned from the case after she had once spoken on this issue being a judge of the preliminary hearing, this was also approved by the GJKKO. From the second draw, the trial panel will be chaired by Daniela Shirka, member Ilirjana Olldashi and the third member is expected to be delegated by the High Judicial Council. We recall that the Supreme Court took the decision on September 28 to return the case for Tahiri to the appeal of the GJKKO with another panel, rejecting the SPAK request for a retrial at first instance. Tahiri was sentenced for abuse of office with 3 years of probation, while the Special Appeal overturned the decision and returned him for retrial in the First Instance. The former minister then appealed and the Supreme Court deliberation room accepted him for trial. Tahiri was charged by the prosecution with three serious criminal offenses "Corruption of senior officials", "Trafficking in narcotics committed in collaboration" and "Structured criminal group", within the 'Habilaj' file. The accusation argued by the prosecution was for the involvement of the former minister in 4 episodes of drug trafficking from 2013-2015, but without giving details about his concrete role. In the reasoned decision of the Court, in the analysis of all the evidence presented by the Prosecution, no fact resulted, to involve the former minister in drug trafficking and cooperation with the Habilaj criminal group, whose leader is Mojsi Habilaj, arrested and on trial in Italy. Also, the court in its reasoning says that after the wiretaps of the Italian prosecution where Habilaj discuss the gifts they will give to the minister, it is appreciated the fact that there is not enough evidence to tie these gifts or monetary amounts that would go to Tahiri. Based on these facts, the court sentenced him to 3 years of probation. appreciated the fact that there is not enough evidence to tie these gifts or monetary amounts that they would go to Tahiri.
