The Socialist Movement for Integration has sent a request to SPAK regarding its lawsuit for incinerators. SMI has previously sued SPAK for the affair of incinerators against Erion Veliaj, Ëngjëll Agaç, Lefter Koka and Alqi Bllakon.
SMI emphasizes that the maximum deadline for the completion of investigations is 2 years and adds that in these conditions would assess compliance with this legal deadline.
Distinguished Prosecutors of the Special Prosecution,
The Socialist Movement for Integration, on 04.03.2021 has filed a criminal report in the Special Structure Against Corruption and Organized Crime (SPAK), against: The Mayor of Tirana, Mr. ERION VELIAJ; The Secretary General of the Council of Ministers, Mr. GNGJËLL AGAÇI; The Head of the Contracting Authority, Former Minister of Environment, Mr. LEFTER KOKA; Former Secretary General of the Ministry of Environment, Mr. ALQI BLLAKO; Concession Commission for the project "For Landfill Construction, Incinerator and Rehabilitation of Existing Landfills Tirana and Electricity Generation".
Also, on 16.12.2021 we have deposited with you material with additional evidence in order to investigate the reported criminal offenses.
As an entity that has a direct legitimate interest in relation to the filed report, as well as based on Article 283 et seq. Of the Code of Criminal Procedure, through this request we request information regarding:
1) Legal status of criminal proceedings;
2) Without prejudice to the principle of investigative secrecy, acts and evidence administered by the Prosecution as well as information regarding the persons under investigation by the Prosecution and the criminal status attributed to the persons under investigation;
3) If there are persons who have criminal status "under investigation" or "defendant", we request information regarding the concrete security measures taken by the Prosecutor of the case.
We bring to your attention that the maximum term provided by Articles 323 and 324 of the Code of Criminal Procedure for the completion of investigations is 2 years. In these conditions, we would maximally appreciate the observance of this legal deadline by your Institution.
