"Criminal cases under investigation..."/ Alibeaj makes a strong request to the Security Commission: Amnesty also for those who prosecuted the PD protests

The Democratic Party presented today to the Security Commission the amendment for the amnesty of those convicted and prosecuted during the protests organized by it.

Deputy Enkelejd Alibeaj, as he presented the DP amendments to the deputies, emphasized some protests called by the blue headquarters, while he also added the protests against the demolition of the National Theater, the protests of the "Astir" area, etc.

"The amendment presented by me is actually structured in three articles. Article 3 of the amendment aims to add an article to Article 6 of the draft law, Article 6/1 with the following content: Article 6/1 granting amnesty for criminal offenses to protesters. Excluded from criminal prosecution and dismissed are all criminal cases under investigation, cases that have not been examined or are in the process of being examined by the courts, as well as for the reports that are in these bodies, regardless of the date of their registration, for criminal offenses committed during gatherings or protests organized in the period October 1, 2018, until December 31, 2020", said Alibeaj.

"So this is the content of the amendment, and as you can see, it is about a group of criminal provisions, which refer to criminal offenses that are essentially related to the organization of gatherings and protests. It is about political gatherings or protests organized by the PD and its allies, but also from civic gatherings or protests organized during this period. It is about the protests organized by the citizens regarding the demolition of the National Theater, the protests of the Astir area, the protests of the citizens for the protection of their homes on the River Bank or Shkoza, or even the student protests. But also for the civil protests in the case of the police killing of Klodian Rasha", continued Alibeaj.

"I am making one last clarification. This is an assessment that the PD has made due to the political responsibility that it has held and should hold every political formation in relation to the organization of protests. One thing is our political responsibility, one thing is the legal and criminal responsibility of individuals who respond to the call for these protests, which will have to be divided. And I will make it clear that: yes, the political responsibility is ours, but the legal responsibility must also remain ours to carry out the protection we have offered to these citizens to the end", said Alibeaj.

"I must make it clear that we are not here to do shopping, but I understand that the government, the Ministry of Justice have started with the intention of making an amnesty. I fully understand the issue of overcrowding. One of the motives for approving it is to make it easier, to reduce the number, so that the treatment conditions are more comfortable. To be clear to everyone, we brought that amendment based on the government's position. We are not for making additions, growth, without the logical sense and without the sense that the law will have to embody. Parliament will have to be very careful in approving the criminal amnesty law", adds Alibeaj.

"The act by which the forgiveness of these convicted people is sought, they will take it as an act of mercy, not as an act to throw it to justice. This is the criterion that should prevail. We, the Democratic Party, have empirically identified these provisions that I listed to you", concludes Alibeaj.
