The member of KAS talks about the registration of the DP of Alibeaj: Here are the 4 alternatives we had for this situation

The member of the Complaints and Sanctions Commission, Ledio Braho, has stated that this body did not decide who is the chairman of the Democratic Party, referring to the decision on the registration of the PD of Alibeaj in the local elections of May 14.

Invited to the show "Log." on "Panorama TV", Braho said that KAS is faced with 4 alternatives, the registration of DP with chairman Lulzim Basha, Enkelejd Alibeaj or Sali Berisha. The last alternative, according to Brahos, was the registration of two DPs, but that is not permissible according to the law.

Ledio Braho: There are two main elements. What pluralism is all about. We had 4 alternatives, an alternative to register the DP under the name of Basha, an alternative under the name of Alibeaj, Berisha or the registration of two DPs. The latter is not legally possible, there are no two DPs. The law prohibits the registration of two parties with the same name in elections.

We take the PD with party leader Lulzim Basha. It is a known fact that Basha has resigned as chairman. We as KAS or CEC could not call Lulzim Basha to resign. We did not decide who is the president of the DP. At the moment that this would be divided between Basha and Alibeaj, it is not for us to decide. We only ascertain what happens in DP.

The chief commissioner raised two elements, the first being the authorization that had no concrete specification. This is too much. It is interpretable and could exceed this. The authorization date was May 18, 2022. There was no way Basha knew the date of the elections. If there was an election date, an authorization, doubts would arise. The commissioner had authorized the representative of Lulzim Basha for any other documentation, except for the solemn act. In the same decision, doubts were cast on this authorization, can the authorization of a resigned chairman be valid. For us as KAS, that authorization was no longer valid, so we forced PD to be ALibeaj in the capacity of the commanding chairman to sign.

Question: Does the law and the code provide for the mandated chairman?

Ledio Braho: The DP statute provides for it. At the moment, in relation to this command, there is no appeal to the DP bodies. The question was asked in the session if there was an appeal to the DP bodies, and none of the parties accepted. The only party that requested the court's confirmation was the DP of the seal. They brought proof.
