The head of the SP parliamentary group, Taulant Balla, commented on the latest political developments.
Balla has announced the opening of a criminal case against President Ilir Meta, who was dismissed by the Assembly the day before.
"The Assembly has produced 2 documents, a report and a decision for dismissal. Both of these documents go to the Constitutional Court as the first institution in line, the decision and the report. This is one.
The report goes to the institution of the General Prosecutor because the law on investigative commissions says that when elements of a criminal offense are noticed, the report is sent to the General Prosecutor. Jurisdiction passes to the prosecution. The Prosecutor General passes to the prosecutor's office in whose jurisdiction the criminal offense is and the person under investigation.
There are elements because after all, Mr. Meta's calls are not only found in the Constitution as illegal, but these calls are found in the criminal code. Calling for violence is punishable by a fine of up to X years in prison. These are assessments that justice institutions should make. We as the Assembly and as a parliamentary group of the SP believe that we have completed our task in that decision of the Assembly yesterday. From now on, the institutions of Justice will have to speak ", declared Balla.
According to him, the two trials, the one in the Constitutional Court and the Prosecutor, if there are any, are separate.
"The Constitutional Court will assess in case the decision meets the criteria and secondly at the core of the issue whether the violations are serious or not. I do not believe there are many dilemmas here to look at. What more can a republican president do to stay in office ?! It is clear that we are on a paved path of confirmation of the President's dismissal, given the opinion of Venice.
"The Constitutional Court is a very independent institution and must do its job," Balla told News24.
