Accused of abusing the ART tender, the lawyer speaks: Thoma Gëllçi did not commit a violation, why is SPAK doing this
Written by SOT.COM.AL 13 Tetor 2021
Dorian Matlia, the lawyer of the former director of RTSH, Thoma Gëllçi, stated tonight that his client has not committed any violation and cannot be accused of abuse of office. According to him, Gëllçi's case is not about procurement procedures.
He stressed that the Prosecution has taken up a case that does not belong to him, while adding that the SPAK and the Prosecution are investigating it together to give a sensational effect to the case of Thoma Gëllçi.
Lawyer: This is a matter of competence, a body has clear obligations. There can be no special prosecution for this criminal offense. I want to clarify a few things. Gëllçi is not charged with anything related to the procurement procedures. In all cases tenders are conducted by the procurement and in no case can it be part of the procurement. The only charge is related to the contractual deadline, not to the public procurement procedures. The prosecution has taken up a case that does not belong to it. Abuse of office is not investigated by the SPAK. They are investigating it together to give a sensational effect to this issue. Whether Gëllçi is guilty or not should be investigated by the Tirana Prosecutor's Office.
