Municipalities can assign to businesses that are debtors in the payment of taxes a local tax employee to control the daily turnover and block at least half of this turnover until the arrears are settled. This is one of the determinations made in a joint instruction of the Ministry of Finance and the Ministry of the Interior, as the responsible ministry of the local government. The instruction entitled "On determining the minimum uniformity of procedural standards for the collection of local tax and fee obligations" was drafted on June 20 and recently published in the Official Gazette. It defines the conditions and deadlines for the initiation of the forcible collection of arrears. In point 1.2 of the third chapter of the joint instruction of the two ministries it is stated that by order of the mayor, or of the head of the local tax administration in cases where this administration is on its own in the municipality, the on-site verification of the commercial activity of the debtor entity begins. The procedure of on-site verification of the daily turnover and sequestration of more than half of this turnover starts when the taxpayer has violated all the deadlines set by the laws and decisions in force for the payment of obligations. When the seizure of money in the treasury is not enough to pay off the arrears of these businesses, then the local tax administration has the right to turn to the National Business Center to block any action, such as the sale or transfer of the business by the debtor owner. In addition, the owner of the debtor entity can be criminally sued and prohibited from leaving the country by a court decision if he has not previously paid off the obligations. The directive allows debtor entities to choose to pay arrears in installments. In this case, the payment also includes late interest, fines, or other interests for late repayment of the obligation. Local taxes include local small business tax, real estate tax, consisting of building tax and agricultural land tax, hotel room tax, real estate transfer tax, payable only from businesses, the fee on the occupation of public space and the tax on the sign, the fee for cleaning, greening, etc., as well as the tax and temporary fees. The instruction of the two ministries follows a report by the Ministry of Finance, which talks about 26 municipalities with major financial problems, two of which are on the verge of bankruptcy.
