SPAK transferred the file as competence to the Prosecutor's Office of Tirana, the families of the 4 killed appeal the decision to the GJKKO for the "January 21" massacre

The family of Aleks Nika, the "Martyr of the Fatherland", who lost his life from the bullets of the Republic Guard during the demonstration on January 21, 2011 in front of the Prime Minister's Office, sent the decision of the Prosecutor's Office to the Court against Corruption and Organized Crime (First Instance of the GJKKO Special against Corruption and Organized Crime for the declaration of incompetence for the report of the 4 Nika, Deda, Veizi and Myrtaj families against the former high heads of state in 2011, Sali Berisha, Lulzim Basha and Ndrea Prendi for the criminal offense "Deliberate murder of to several persons, committed by a criminal organization by persons with high state functions". With petitioner Rajmonda Nika and legal representative lawyer Idajet Beqiri, the families of the 4 "Martyrs of the Motherland" request the annulment of the SPAK decision that passed the case to the Prosecutor's Office of Tirana. This request was sent on March 13. We recall that earlier, SPAK refused to take into account even the 2 reports of SP for "January 21".

The appeal will be reviewed on March 29 by judge Elsa Ulliri

The request of the Nika family will be examined by judge Elsa Ulliri on March 29, at 2:00 p.m. in the consultation room. "Against the decision of the Special Prosecutor's Office against the incompetence of the subject matter and the sending of the case against the accused Sali Berisha, former Prime Minister of the Republic of Albania; Lulzim Basha, former Minister of the Interior and Ndrea Prendi, former commander of the Republic Guard, in the Prosecutor's Office near the Court of First Instance in Tirana. The hearing for the review of the above request is scheduled to take place on 29.03.2023, at 14:00. The review of the case will take place in the counseling room", it is written in the announcement of GJKKO.

SPAK's answer: There are no perpetrators of the murders of Hekuran Deda and Aleks Nika

In the SPAK letter sent to the Prosecutor's Office of Tirana at the end of last month, it is said that the author(s) of the murders of Aleks Nika and Hekura Deda have not yet been found, 12 years after the event, therefore, the report against Berisha, Basha and Prend by the Nika, Deda, Myrtaj and Veizi families cannot be taken into consideration by SPAK. In the end, Altin Dumani requests that the Prosecutor's Office of Tirana itself give an answer to this report. "Also, until these moments of the investigation being carried out by the Prosecutor's Office at the Court of First Instance in Tirana, it turns out that the perpetrators of the criminal offense have not been identified and therefore, it has not been possible to prove that the perpetrators could be special subjects, according to article 75/a, of the Code of Criminal Procedure and article 3 of law no. 95/2016 'On the organization and functioning of institutions to fight corruption and organized crime'. For this reason, referring to article 75/a, 76 and 28 of K. Pr. Criminal, we forward to you for subject competence the material referred to no. K. 137, dated 16.02.2023, for the purpose of your assessment", is written on pages 2-3 of the letter of the head of SPAK, Altin Dumani.

SPAK pranon ta marrë çështjen nëse Prokuroria e Tiranës gjen prova të reja

Në fund, SPAK lë vetëm si mundësi marrjen në dorë të çështjes së “21 janarit” vetëm nëse Prokuroria e Tiranës zbulon prova të reja për ekzekutimet e Hekuran Dedës dhe Faik Myrtajt dhe emrat e personave përgjegjës për vrasjet e tyre.  Me pak fjalë, njësoj si në rastet e kaluara, edhe pse ka prova se vrasjet “21 janarit” janë krime shtetërore, SPAK heq totalisht përgjegjësinë nga vetja dhe ia hedh “topin” Prokurorisë së Tiranës. “Nëse në vijim të verifikimeve apo hetimeve, do të konstatohet ekzistenca e ndonjë vepre penale apo subjekt në kompetencë hetimi sipas nenit 75/a të Kodit të Procedurës Penale, atëherë, aktet e procedimit penal të dërgohen për kompetencë lëndore në Prokurorinë e Posaçme Kundër Korrupsionit dhe Krimit të Organizuar, referuar dhe nenit 28 të Kodit të Procedurës Penale”, mbyllet letra e Altin Dumanit drejtuar Prokurorisë së Tiranës.

SPAK i kaloi Prokurorisë së Tiranës dhe 2 kallëzimet e Manjës dhe PS

Në 9 shkurt, SPAK vendosi të mos marrë përsipër shqyrtimin e kallëzimeve të Partisë Socialiste dhe Ministrit të Drejtësisë, Ulsi Manja, të cilët kërkojnë ndjekjen penale dhe gjykimin e 3 protagonistëve të tragjedisë së 12 viteve më parë, Sali Berishës, Lulzim Bashës dhe Ndrea Prendit për vrasje në rrethana cilësuese, shpërdorim detyre, rrethana rënduese, etj. Prokurorja e SPAK, Manjola Kajana shpalli moskompetencë për këto 2 kallëzime të dërguara në muajin janar, pasi nuk është dorëzuar materiali origjinal i audio-përgjimit të komunikimit të Prendit me vartësit të tij gjatë kohës kur po sulmohej Kryeministria dhe Garda po përgatitej për t’u kundërpërgjigjur me armë zjarri. Për rrjedhojë, dosja me kallëzimet ndaj ish-krerëve të lartë shtetit në 2011 iu kalua Prokurorisë së Tiranës. Në këtë situatë, një nga çështjet që opinioni publik pritur me shpresë për shumë vite se do të zbardhet plotësisht rrezikon të futet në kanalet e errëta të harresës, pasi institucionet juridike kanë hequr dorë nga trajtimi i “21 janarit” duke ia hedhur përgjegjësinë njëra-tjetrës.
