Journalist Elton Qyno has learned that it is precisely this European court that finally decides, putting an end to the legal debate started in many countries, including Albania, whether the collection and distribution of data intercepted by the prosecution and the police through the crypto telephone network "EncroChat" ” and “Sky Ecc” is in accordance with European law.

The decision, which is expected to be taken at the end of 2023, will clarify whether the conversations transcribed in the "Sky Ecc" and "Encro Chat" applications will be valid or not, to be used as evidence in criminal proceedings initiated in several countries EU and not only.

Initially, it is expected that the lawyers on October 27, 2023, will give the conclusions and a preliminary opinion on the issue of the transcription of the conversations. While the 15 judges of the ECJ are expected to come out with a final decision at the end of the year.

After giving the decision, which will justify the acceptance or not of these conversations as evidence, further the decision will be referred to the Regional Court of Berlin.

In fact, in October 2022 it was a judge of the Regional Court of the Landgericht Berlin, who channeled this case to the European Court of Justice in Luxembourg.

The purpose of setting this court in motion is to give a final legal interpretation, if the privacy rights of European citizens have been violated and if there is a place for these conversations to be used as evidence in criminal proceedings.

One of the questions raised by the Berlin judge for the European court is the fact whether it is legal to share the hacked messages of "EncroChat" and "Sky ECC" with other EU countries and not only by French justice.

Në fakt në 4 korrik 2023, në gjyqin e zhvilluar në GJEDU, nuk ishin ftuar vetëm avokatët për të dhënë pretendime, por edhe prokurorët.Në këtë seancë kanë qënë të pranishëm dhe gjyqtarët e dhomës referuese të Gjykatës Rajonale të Berlinit, përfaqësues të Gjykatës Kushtetuese Federale dhe Zyrës së Prokurorit të dhe avokatë mbrojtës nga vende të tjera evropiane.

Gjatë seancës që zgjati 7 orë, prokurorët nga Franca, Gjermania, Holanda, Spanja, Hungaria, Suedia, Republika Çeke dhe Irlanda në 4 korrik, dhanë dëshmi gojore në Gjykatën e Drejtësisë së Bashkimit Evropian, duke diskutuar Përgjithshëm rastin kompleks që fokusohet në të drejtën evropiane.

Seanca dëgjimore erdhi disa ditë pas një konference për shtyp të organizuar gjerësisht të organizuar nga “Europol”, në të cilën prokurorët njoftuan se nga një operacion i përbashkët francez dhe holandez, kishte çuar në 6500 arrestime të njerëzve të përfshirë në krimin e organizuar dhe trafikun e drogës.

Edhe pse në Gjermani një gjykatë e shkallës së parë të një landi, vendosi të rrëzojë këto biseda. Një vendim gjykate Apelimi në Gjermani, i ka cilësuar të rregullta këto biseda…”, deklaroi para gazetarëve prokurori, Altin Dumani.
